Artist Terms and Conditions

Definitions                                                                                                                                                         

Artcore Gallery Online means Artcore Ltd

The artist means you, a user of our services.

Website/site means website artcoregallery.org.uk

Artwork means artwork/craftwork owned and controlled by the artist for the purposes of selling/exhibiting through the website.

Service means the process of displaying/marketing/selling your artwork through the website artcoregallery.org.uk

Acceptance of Artist

Artcore Gallery online curates the website and we reserve the right to accept or decline applications to market and sell artworks.

Applications to the site includes acceptance of these terms and conditions

Information supplied to Artcore Gallery is accurate, and up to date.

The artist agrees to have artworks and descriptive information displayed on the Artcore Gallery online website.

The artist will inform Artcore Gallery of any changes in circumstance including name, address and contact details, pricing, the sold status of artworks, and if you are on holiday.

Acceptance of Artworks

Artcore Gallery reserves the right to accept or decline applications to market any artwork through Artcore Gallery online website for any reason.

If a sale is made from Artcore Gallery online website, the artist is entering into a legally binding contract with Artcore Gallery to complete the sale and despatch the artwork in the agreed time.

Non-exclusivity

Artists may market and sell artwork through other channels simultaneously as marketing through Artcore Gallery.

If an artwork is sold independently the artist must either remove it from the site, or mark it as sold

Artworks are not offered at a price lower than the price which is displayed on Artcore Gallery online website.

Copyright

The artist warrants that all artwork sold through Artcore Gallery online website is free of any copyright restrictions or intellectual property disputes.

The artist guarantees the artwork is theirs to sell

The artist grants Artcore Gallery online licence to use photographs of their submitted artworks on the website and in any marketing materials, including on any websites, social media, in any advertising campaigns, online or offline, at any time.

Images

Artists must supply up to three high-quality digital Images of each artwork to be featured on the Artcore Gallery online website.

The images must be in .jpeg format (1200 x 1200 pixels).

One image will show the entire artwork including frame (if framed).

The detail image will show a portion of the artwork to illustrating the texture of the canvas or any other medium.

The artist agrees to supply a digital photograph of themselves; an artist’s statement; information about each artwork including the title, size of artword, medium and price.

Artwork Pricing

There is no charge for displaying works up to 10 works on Artcore Gallery online until January 2018.  After this time there will a subscription charge of £20 for 3 months, £30 for 6 months and £50 for 12 months.

After January 2018 the artist can decide to opt out of the membership out or continue by paying the subscription fees.

The artist is responsible for setting the price of the artwork.

The price of the artwork must be inclusive of 30% commission (net of VAT) for Artcore Gallery online.  VAT (if applicable) will be charged in addition to the selling price of the artwork.  This commission covers running costs for the site, advertising and marketing, credit card processing, invoicing, and administration.

Once terms and conditions are accepted the artist agrees to sell the artwork at the agreed price.

Delivery, packaging and insurance

The artist is responsible and liable for costs of all materials, packaging, delivery and insurance costs.  The price of the artwork should therefore reflect these costs.

The buyer will be asked for an additional charge for overseas shipment.

Sold artworks are packaged and sent to the buyer from the artist directly.  The artist must ensure that Artworks are securely packaged, labelled and insured for safe delivery to the Buyer.

In the event of a sale, the artist will be notified.  The artist will be responsible to package and arrange delivery of artworks to the buyer within a maximum of five working days of receiving the sale notification.

If the artist becomes aware that an artwork ordered will not be dispatched within 5 days of the sale notification, it is the artist’s responsibility to notify Artcore Gallery online immediately for the reason and potential length of the delay.  This may result in the buyer cancelling the order.

Damaged and Returned goods

In the event of an artwork arriving damaged with the buyer, the artist will be liable for the costs of regaining the artwork.

The artist will be liable for any costs undertaken in regaining damaged artwork.  Artcore Gallery online will not accept claims for reimbursement of damage to artworks under any circumstances.

If the artwork is returned within the statutory period of 14 days, the artist will not be paid.  This will constitute a cancelation of the order.

In the event of a return or damaged goods, Artcore Gallery online will release the artist’s contact details to the buyer.

Payment for Artworks

The artist will be paid by Artcore Gallery online 28 days after the sale of the artwork, once confirmation has been received by the buyer.

Payment will be made by bank transfer.

Disclaimer

Artcore Gallery online reserves the right to change artist terms and conditions, as necessary to support our business objectives, by giving a minimum of 28 days’ notice to the artist.

Using the service constitutes acceptance of these rules.
